Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a binding legal agreement between the client (“Client”, “you”) and JAS DigiCraftTek (A unit of JAS Group of Enterprises)(“JAS DigiCraftTek”, “we”, “us”).

By commissioning a software project, signing a Statement of Work (SOW), accepting an official quote, or engaging any of our digital services, you confirm that you have read, understood, and agreed to these Terms.

2. Services & Scope of Work

JAS DigiCraftTek specializes in custom digital engineering services, including:

• Custom Web Application Development (React, Next.js, Node.js, modern full-stack architectures)
• Software Quality Assurance, Automation & Performance Testing
• Cloud Infrastructure Design, Migration & GCP/Firebase Hosting Support
• Bespoke UI/UX Design and Brand Assets
• Technical Resource Outsourcing and IT Consulting

All project specifications, timelines, and deliverables are explicitly defined within the agreed Statement of Work or project invoice. Any changes outside the initial scope will be documented and billed through an agreed Change Order.

3. Client Responsibilities

To ensure project success and timely delivery, the Client agrees to:

• Provide required assets, content, brand guidelines, and third-party credentials in a prompt manner.
• Designate an authorized primary contact person for approvals and feedback reviews.
• Ensure all materials (text, images, media, proprietary data) supplied to us do not infringe third-party copyrights or trademarks.

4. Proposals, Milestones & Payments

Projects are structured with clear milestone checkpoints to provide mutual transparency:

• Initial Deposit: Work commences upon confirmation of the project kickoff deposit.
• Milestone Invoicing: Invoices are issued upon milestone completion as set out in the proposal.
• Payment Terms: Invoices are payable in INR (or USD for international clients) within the net period specified on the invoice.
• Production Deployment: Final deployment to production domains, root admin access, and repository transfer are granted upon 100% settlement of the agreed project fees.

5. Intellectual Property & Code Ownership

JAS DigiCraftTek retains ownership of pre-existing development frameworks, proprietary reusable utility scripts, and open-source packages (e.g. Next.js, Tailwind CSS), which are licensed to the Client under their respective permissive open-source terms.

6. Confidentiality & Non-Disclosure

Both parties agree to hold all non-public technical and business disclosures in strict confidence. JAS DigiCraftTek will not share your source code, data schemes, or commercial strategies with any unauthorized third party.

7. Post-Launch Warranty & Support

We stand behind the quality of our craftsmanship. Every custom development project includes a 30-Day Post-Launch Defect Warranty, during which we promptly fix any reproducible bugs or discrepancies from the agreed scope at zero additional cost.

Ongoing maintenance, continuous feature expansion, and server administration beyond the 30-day warranty window can be engaged through our monthly maintenance plans.

8. Limitation of Liability

To the maximum extent permitted by applicable law, neither party shall be liable for indirect, incidental, punitive, or consequential damages (such as lost profits or business interruptions). In any circumstance, JAS DigiCraftTek’s cumulative liability shall not exceed the total fees paid by the Client under the specific Statement of Work giving rise to the claim.

9. Governing Law & Jurisdiction

These Terms and any project contracts executed hereunder shall be governed by and construed in accordance with the substantive laws of the Republic of India. Any legal disputes arising in connection with our services shall be subject to the exclusive jurisdiction of the competent courts located in Kanniyakumari District, Tamil Nadu, India.
